Terms of Use

Statement of Intent

It is the intent of KnightGuard.Net to provide Web Site owners/operators with a monitoring tool that gives them first-alert notice of a Web Site outage.

Acceptable Use

It is intended that KnightGuard.Net be used only by Web Site owners/operators (referred to here as Clients and/or Subscribers), for the intent of first-alert notification of Web Site service trouble for their own Web Sites and/or Internet devices . Use of KnightGuard.Net to disturb sites (or people ) other than their own will be cause for termination of service at KnightGuard.net's sole discretion.

Privacy

The information you provide to KnightGuard.Net will be used for the sole intent of providing and maintaining service to clients. Personal information will not be sold or distributed to other parties. Such information includes, but is not limited to e-mail addresses, phone numbers, mailing addresses, credit card and other billing information.

Guarantee

KnightGuard.Net provides monitoring services to improve our client's ability to make reparations quickly in the event of an outage. However, KnightGuard.Net cannot guarantee this service will be flawless. Service is provided on an as-is basis.

E-Mail Notification (added 6/23/02)

When e-mail notification is made to Pager E-mail addresses, such notification is made on behalf of the subscriber. That is, the e-mail message is formatted as if to come from the subscriber's registered e-mail address. The reason for this is so that the subscriber receives any bounced messages should the alert addresses be incorrect.

Subscribers take full responsibility for the accuracy and appropriateness of each alert address for the URLs monitored in their accounts. Incorrect or improper alert addresses may be removed as deemed necessary by KnightGuard.net. Abuse of Alert Notification Addresses (ie. sending alerts to others who do not want them) will be considered terms for immediate cancellation of the Subscriber's account.

Traffic

The client understands that by it's very nature, KnightGuard.Net's service generates traffic to the site. Some ISPs monitor the amount of traffic to your site, and charge additional service fees if traffic exceeds certain quotas. The client agrees that KnightGuard.Net cannot be held responsible should traffic quotas be exceeded.

Liability

Though KnightGuard.Net has been tested and continues to undergo improvements, the possibility exists that KnightGuard.Net will fail to report an outage or even report an outage that does not exist. The customer agrees that KnightGuard.Net cannot be held responsible for Site, Network, or Server failures or the loss of business or data which may result, even if KnightGuard.Net's own service fail to make notification.

KnightGuard.Net's liability in any case shall be limited to the cost of subscription to the KnightGuard.Net service. This limit of liability includes liability of Sewell Computer, the operator of KnightGuard.Net.

Subscription Fees

Subscription fees are paid in advance of the service term, unless other arrangements are made in advance. Subscription fees are non-refundable.

Change of Terms and Conditions

These Terms of Use are subject to change based on the needs of our subscribers and the standards of the Internet in general.
